The Higher Education Act (HEA) is the federal legislation that authorizes U.S. Department of Education educational programs and funding streams including the federal financial aid program. Congress is currently in the process of reauthorizing the HEA, which happens only once a decade. This session will provide an important update to all AACS members participating in federal student aid programs. It will include a discussion of the hot topics around HEA reauthorization including new and proposed amended accountability proposals, and the latest on timing of HEA legislation in the House and Senate. We will also discuss the process in place for engagement of AACS with Congress on this process, through the AACS Government Relations Committee and membership as a whole. Specific topics include proposals in HEA that address: 90/10, Gainful Employment, Borrower Defense to Repayment, CDRs, nonprofit conversions, instructional cost, short term program Pell Grants, marketing and others.

In 2016, the Obama administration issued the Borrower Defense to Repayment Rule. Implementation of this rule was delayed by the current administration while they undertook a new negotiated rulemaking. Ultimately, the delay was challenged and the current administration issued guidance in March 2019 implementing the 2016 rule. We expect to see a 2019 version of the BDR rule prior to November 1, 2019. This session will unwind the Borrower Defense to Repayment Rule; focusing on implementation of the 2016 rule and transitioning to the potential changes under a revised BDR rule (not yet released at time of publication). The presenters will review the financial responsibility triggers, the arbitration and class action provisions, and the definitions in the rule.

Yvonne Mascolo began her cosmetology career in 1999, as a receptionist for TONI&GUY salons and attended the TONI&GUY Hairdressing Academy in 2002. She progressed her salon career from behind the chair into management, education and platform work. She then became an academy instructor and Regional Education Director and is now the Vice President of Company Owned Academies for TONI&GUY USA.
